L’attuale emergenza sanitaria ha imposto, come oramai noto a tutti, forti limitazioni al diritto di movimento di ognuno di noi, consentito esclusivamente per evidenti e comprovate necessità. Rientrano tra queste ipotesi, ad esempio, fare la spesa, esigenze sanitarie o altri bisogni  improcrastinabili che devono essere tutti espressi e descritti nel modulo di autocertificazione che deve accompagnare ogni singola uscita.

Qualora le Forze dell’Ordine addette al controllo fermino qualcuno che circola in assenza del modulo o qualora ritengano che la ragione dello spostamento non rientra tra quelle necessità non differibili, oppure ancora che sussistano altre ragioni per sollevare la contestazione, procederanno a denunciare il cittadino per violazione dell’articolo 650 c.p. Si tratta di una contravvenzione che punisce la violazione di un ordine dell’Autorità. Occorre evidenziare come la contravvenzione non sia equivalente a violazione amministrativa, quale la violazione al codice del strada, trattandosi  pur sempre di un reato.

Pertanto, a seguito di questa attività di polizia non verrà rilasciato alcun bollettino da pagare, ma si procederà con una denuncia, a piede libero,  alla Procura della Repubblica. A partire da quel momento si instaura un procedimento penale vero e proprio .

Dunque, all’atto del controllo e della contestazione verrete invitati ad eleggere domicilio e a nominare un difensore di fiducia o, in assenza, ne verrà nominato uno di ufficio, con il quale sarà opportuno mettersi quanto prima in contatto.

In base all’atto che il P.M. titolare del procedimento notificherà alle parti ( sia all’indagato che al proprio legale) si potrà scegliere la strada processuale più idonea per garantire il miglior risultato per l’indagato.
