Dal 1° gennaio 2019 anche le bollette del gas, così come quelle della luce, si prescrivono in 2 anni. La prescrizione riguarda solo quelle che verranno emesse a partire da questa data e non per quelle precedenti già emesse.
Ora non rimane che attendere la riduzione dei tempi della prescrizione anche per le fatturazioni delle utenze idriche che entrerà in vigore il prossimo 1° gennaio 2020.
Da quella data le fatturazioni ordinarie e a conguaglio delle utenze domestiche dei servizi essenziali saranno uniformate, mettendo fine ad una pratica che ha impattato per anni in maniera pesante su tutti i consumatori.
La riforma dei termini di prescrizione delle bollette di luce, acqua e gas non tocca solo le bollette per consumi ordinari ma anche i conguagli, inoltre il nuovo termine di due anni riguarda sia i consumatori (le famiglie e gli utenti privati) che le microimprese, i professionisti e le società.
A modificare i termini di prescrizione delle bollette della luce, gas e acqua è stata la legge di bilancio del 2018: la nuova norma contiene infatti una deroga al codice civile che, invece, stabilisce una prescrizione di cinque anni per tutti i debiti da pagarsi con cadenza annuale o frazioni inferiori (ad esempio ogni mese, ogni bimestre, ecc.). Resta pertanto di cinque anni la prescrizione delle bollette del telefono e di tutte le altre utenze.
Pertanto, se si riceve una bolletta della luce, acqua o gas riferita a consumi di oltre due anni fa non bisogna più pagare. Il debito infatti si è ormai prescritto.
Per una maggiore trasparenza sugli importi prescrittibili e per rendere più facile al cliente esercitare il proprio diritto, i venditori saranno tenuti a emettere una fattura separata contenente esclusivamente gli importi per consumi risalenti a più di 2 anni. In alternativa, tali importi dovranno essere evidenziati in maniera chiara e comprensibile nella fattura contenente anche gli importi per consumi più recenti di 2 anni. In ogni caso, i venditori sono tenuti ad informare il cliente della possibilità di eccepire gli importi prescrittibili e a fornire un format che faciliti la comunicazione della sua volontà di non pagare.
È quanto ha stabilito la delibera 569/2018/R/com, che si inserisce nel procedimento di attuazione delle misure introdotte dalla Legge di bilancio 2018 (legge 205/2017), nell’ambito del quale sono già state adottate le delibere 97/2018/R/com e 264/2018/R/com in vigore dalla scorsa primavera.
Inoltre, gli importi oggetto di prescrizione dovranno essere automaticamente esclusi dai pagamenti nel caso fosse stata scelta la domiciliazione bancaria/postale o su carta di credito come modalità di addebito.
Alla luce di ciò, famiglie e piccole imprese saranno maggiormente protette dal rischio di dover pagare le cosiddette “maxibollette”, cioè importi di entità molto superiore al consueto, derivanti da rilevanti ritardi dei venditori (ad esempio blocco di fatturazione), rettifiche del dato di misura precedentemente fornito dal distributore e utilizzato per fatturare o perduranti mancate letture del contatore da parte dei distributori.
