ASSEGNI FAMILIARI. VANNO AGGIUNTI ALL’ASSEGNO DI MANTENIMENTO PER I FIGLI. ATTENZIONE!

Gli assegni familiari spettano al genitore presso cui i figli sono collocati e vanno aggiunti all’assegno di mantenimento per i figli.

Ne consegue che se il genitore che percepisce gli assegni familiari non è il genitore collocatario deve corrisponderli alla moglie.

Il principio può essere superato dallo volontà delle parti e/o da una diversa disposizione del Giudice.

L’art. 211 della legge 19 maggio 1975, n. 151 espressamente prevede che il coniuge cui i figli sono affidati ha diritto in ogni caso a percepire gli assegni familiari per i figli, sia che ad essi abbia diritto per un suo rapporto di lavoro, sia che di essi sia titolare l’altro coniuge.

L’assegno al nucleo familiare non può essere richiesto da entrambi i genitori ma solo da uno dei due in accordo tra loro. In caso di disaccordo prevale il collocatario.

Attenzione alla prescrizione del diritto agli assegni familiari che è di 5 anni per la richiesta all’INPS.

Attenenzione perche si può commettere l’illecito dell’appropriazione indebita che costituisce reato.

Attenzione perchè chi ha percepito e trattenuto indebitamente gli assegni familiari avrà l’obbligo di restituire tutte le somme erogate negli ultimi 10 anni.

Attenzione perchè gli assegni familiari vanno aggiunti all’assegno di mantenimento per i figli.
