In data 24 marzo 2020 il Consiglio dei Ministri, con un nuovo decreto legge torna sui suoi passi e stabilisce, nell’ottica di contenimento del contagio da Covid-19, che ai trasgressori, non verrà più contestata la fattispecie contravvenzionale di cui all’articolo 650 c.p. ma una sanzione amministrativa del pagamento di una somma da 400 a 3000 euro.
Dunque, il contravventore avrà la possibilità, seguendo le ordinarie norme che disciplinano la materia, o di pagare la sanzione comminata o proporre impugnazione.
Verrà contestata la fattispecie di cui all’articolo 452, primo comma, n. 2, del codice penale (reclusione da uno a cinque anni), peraltro ben più grave di quella originariamente prevista dell’articolo 650 c.p., in caso di violazione intenzionale del divieto assoluto di allontanarsi dalla propria abitazione o dimora per le persone sottoposte a quarantena perché risultate positive al virus.
Qualora il mancato rispetto delle misure riguardi pubblici esercizi o attività produttive o commerciali si applicherà altresì la sanzione accessoria della chiusura dell’esercizio o dell’attività per un periodo dai 5 ai 30 giorni. In caso di reiterata violazione della medesima disposizione la sanzione amministrativa è raddoppiata e quella accessoria è applicata nella misura massima.
