Primoconsumo sta predisponendo un ricorso al TAR Lazio contro l’estensione del contributo di soggiorno agli alloggi turistici. I proprietari/gestori di affitti turistici a Roma e gli ospiti che hanno pagato il contributo dal 21 aprile, possono aderire al ricorso fino al 4 giugno( il termine per ricorrere scade il 10 giugno 2018)

Il contributo di soggiorno è una tassa, la cui gestione da parte di proprietari e gestori comporta numerosi obblighi e adempimenti tra i quali: trattenere la tassa, versarla, certificarla, denunciarla trimestralmente e annualmente.

Il Consiglio Comunale di Roma Capitale ha adottato, il 30 marzo 2018, la deliberazione n. 32 con la quale ha esteso agli alloggi turistici il contributo di soggiorno già dovuto dal 2011 dagli ospiti di Bed&Breakfast, Case Vacanze e Affittacamere.

Primoconsumo ha deciso di promuovere un ricorso al TAR del Lazio contro la recente estensione del contributo di soggiorno agli alloggi per uso turistico da parte di Roma Capitale.

Dall’analisi del regolamento  emergono vari profili di illegittimità.

Il nuovo regolamento prevede che il soggetto che incassa il canone/corrispettivo della locazione ha l’obbligo di riscuotere il contributo di soggiorno ed è responsabile del pagamento del contributo..

Il contributo di soggiorno colpisce anche i soggetti che hanno prenotato e pagato il loro soggiorno a Roma prima del 30 marzo 2018 (data di approvazione della delibera n. 32/2018) e costituisce anche un costo aggiuntivo rilevante alle prenotazioni già pagate prima del 30 marzo, con possibile danno alle relazioni con gli ospiti e al gradimento delle strutture.

I proprietari, i gestori di affitti turistici, possono aderire al ricorso preferibilmente fino al 04 giugno 2018 (il termine per ricorrere scade il 10 giugno 2018).
