L’attuale riforma di condominio com’è noto, ha ampliato di molto i compiti e le responsabilità dell’amministratore di condomino, fornendo ai condomini nello stesso tempo, più mezzi per potersi difendersi in casi di problemi.

Il rapporto tra amministratore di condominio e condomini è da considerare come un rapporto lavorativo, e come tale può interrompersi o essere interrotto, nel caso sussistano alcuni fattori. In genere si dice che un amministratore può vedersi revocare il proprio incarico senza giusta causa o per giusta causa.
L’art. 1129 c.c., al comma 11, conferisce, infatti, all’assemblea il potere di revocare in ogni tempo l’amministatore adottando una delibera in tal senso con la stessa maggioranza prevista per la sua nomina secondo quanto previsto dall’art. 1136 c.c.
Pertanto, ove sussista la volontà espressa dalla maggioranza degli intervenuti, rappresentanti almeno la metà del valore dell’edificio, l’amministratore può essere revocato ad nutum, ovvero indipendentemente dall’esistenza di una giusta causa.
Proprio l’assenza di qualsiasi violazione degli obblighi imposti dalla legge a fondamento di una simile revoca, determina la sussitenza in capo all’amministratore rimosso del diritto al risarcimento del danno.
E’anche possibile la revoca tacita, essendo sufficiente la nomina di un nuovo amministratore perchè quello precedente si consideri revocato.

Il successivo comma 12 dell’art. 1129 c.c. esplicita le gravi irregolarità in cui può incorrere l’amministratore nella gestione del condominio e che possono determinare la sua revoca per giusta causa:
– l’omessa convocazione dell’assemblea per l’approvazione del rendiconto condominiale, il ripetuto rifiuto di convocare l’assemblea per la revoca e per la nomina del nuovo amministratore o negli altri casi previsti dalla legge;
– la mancata esecuzione di provvedimenti giudiziari e amministrativi, nonché di deliberazioni dell’assemblea;
– la mancata apertura e utilizzazione del conto corrente postale o bancario intestato al condominio;
– la gestione secondo modalità che possono generare possibilità di confusione tra il patrimonio del condominio e il patrimonio personale dell’amministratore o di altri condomini;
– l’aver acconsentito, per un credito insoddisfatto, alla cancellazione delle formalità eseguite nei registri immobiliari a tutela dei diritti del condominio;
– qualora sia stata promossa azione giudiziaria per la riscossione delle somme dovute al condominio, l’aver omesso di curare diligentemente l’azione e la conseguente esecuzione coattiva;
– l’inottemperanza degli obblighi di cui all’art. 1130 numeri 6), 7) e 9) c.c., afferenti rispettivamente la tenuta del registro di anagrafe condominiale, la tenuta del registro dei verbali delle assemblee, del registro di nomina e revoca dell’amministratore e del registro di contabilità, nonché l’obbligo di fornire al condomino che ne faccia richiesta attestazione relativa allo stato dei pagamenti degli oneri condominiali e delle eventuali liti in corso;
– l’omessa, incompleta o inesatta comunicazione dei dati anagrafici, professionali, fiscali, ecc. richiesti al momento dell’accettazione della nomina e ad ogni rinnovo dell’incarico, ai sensi dell’art. 1129, comma 2 c.c.

E’ bene precisare tuttavia come la casistica riportata non abbia carattere esaustivo, considerazione questa avvalorata dallo stesso tenore letterale della norma in commento e dalla locuzione “tra le altre” utilizzata dal legislatore.
La giurisprudenza ha infatti permesso di estendere il novero delle anomalie censurabili a tutti quei comportamenti che inducano il singolo condomino a sospettare una gestione anomala da parte dell’amministratore, con il solo limite della gravità.
A mero titolo esemplificativo, potrà essere oggetto di valutazione da parte dell’Autorità Giudiziaria, stimolata in ciò dal condomino legittimamente sospettoso, anche il comportamento dell’amministratore che, esulando dalle proprie specifiche funzioni, cerchi di influenzare l’assemblea al fine di ottenere l’adozione di delibere gradite ad alcuni condomini ed osteggiate da altri, in particolare ove un simile comportamento sia reiterato nel tempo e volto a favorire sempre gli stessi condomini.

Il Tribunale di Sciacca (sentenza 16 giugno 2014) ha revocato l’amministratore ex articolo 71- bis disposizioni attuative Cod. Civ. perché condannato, con sentenza definitiva, per il reato di omesso versamento delle trattenute previdenziali. Dato che si tratta di «un’ipotesi speciale di appropriazione indebita», esso costituisce una causa ostativa allo svolgimento dell’incarico di amministratore di condominio, perché determina la perdita del possesso di uno o più dei requisiti indicati dall’articolo 71 bis delle disposizioni di attuazione del Codice civile.

Il divieto di “rinomina” dell’amministratore revocato sembrerebbe essere stato interpretato in modo estensivo dal Tribunale di Lecco (sentenza del 13 giugno 2014), che annullava la delibera assembleare con la quale era stato nominato amministratore del condominio la moglie di quello precedentemente revocato dal Tribunale, in quanto la nomina ripetuta dell’amministratore revocato (o di persone a lui riconducibili, come la moglie), anche se da parte della maggioranza dei condomini, aveva ingenerato diversi contenziosi giudiziari con grave pregiudizio per l’interesse alla corretta gestione della cosa comune, situazione che, secondo il giudice di merito, si sarebbe perpetrata, con l’attuale amministratrice, stante il rapporto personale tra i due.

Di recente il Tribunale di Trento (ordinanza del 1° dicembre 2014) ha revocato un amministratore perché ha «dimostrato una inescusabile superficialità per aver posto in essere un’attività in sé incompatibile con la tutela delle parti comuni»: senza alcuna autorizzazione aveva praticato un’apertura sul muro al di sopra della porta tagliafuoco tra l’accesso ai garage dal giro scala, così vanificando la struttura e le misure antincendio, impedendo di fatto ai condomini di parcheggiare l’auto nel garage interno, oltre a non aver curato la tenuta del registro anagrafe condòmini e non aver pubblicizzato i propri dati anagrafici nella bacheca condominiale.

Il Tribunale di Messina ha specificato che “costituisce grave irregolarità, tale da determinare la revoca dell’incarico, il comportamento dell’amministratore di condominio che, richiestone da uno dei condomini, ometta per un lungo tempo e comunque al di là di un termine ragionevole di consegnare o di offrire in visione i documenti o di comunicare dati relativi alla gestione condominiale” (Trib. Messina 22 gennaio 2013).

L’art. 1129 c.c., infine, al comma 12, introduce un’ulteriore ipotesi di revoca dell’amministratore, giustificata dall’emersione di gravi irregolarità fiscali o dalla mancata osservanza da parte dell’amministratore dell’obbligo di apertura ed utilizzazione del conto corrente bancario o postale intestato al condominio.
In questi casi i condomini, anche singolarmente, possono chiedere la convocazione dell’assemblea per far cessare la violazione e revocare il mandato all’amministratore.
Il carattere distintivo consiste nel fatto che, in quest’ultima ipotesi, la condotta dell’amministratore subirà dapprima il vaglio dell’assemblea dei condomini che, ove effettivamente rilevi tali irregolarità, potrà procedere alla revoca con le maggioranze già viste in tema di revoca ad nutum.
Tuttavia, ove nel corso dell’assemblea non sia possibile raggiungere il quorum richiesto dalla norma per la revoca dell’amministratore, ciascun condomino (non necessariamente quello che aveva già sollevato la questione rivolgendosi all’assemblea) potrà adire l’Autorità Giudiziaria competente al fine di ottenere la revoca dell’amministratore.
Ove poi la domanda giudiziale di revoca venga accolta, il ricorrente ha valido titolo per rivalersi nei confronti del condominio ai fini della rifusione delle spese legali sostenute, ma a sua volta il condominio “soccombente” potrà rivalersi nei confronti dell’amministratore revocato.
