Il consumatore a cui è stato cancellato un volo a causa di “congestione del traffico aereo” va risarcito. E’ quanto ha stabilito il Giudice di Pace di Roma in una recente sentenza dell’agosto 2019 intrapresa dal consumatore con atto di citazione di fine aprile 2019.
Al consumatore era stato cancellato il volo poche ore prima della partenza ed allo stesso era stato offerto solo un volo nelle 48 ore successive con lo stesso vettore da Catania a Roma. Il consumatore doveva però rifiutare la “riprotezione” stante la coincidenza per altri due voli da Roma in giro per l’Europa .
Acquistato invece un altro biglietto con altro vettore il consumatore raggiungeva in tempo le coincidenze e le sue destinazioni. Al rientro chiedeva il risarcimento ed il rimborso del volo aereo ma il vettore negava ogni addebito trincerandosi dietro la cancellazione dovuta a “congestione del traffico aereo”.
Il Giudice dava ragione al consumatore condannando il vettore alla restituzione del prezzo pagato per il volo cancellato, al rimborso del prezzo del biglietto del secondo vettore e riconosceva inoltre l’indennizzo per il disagio, oltre al rimborso delle spese legali.
Si tratta dell’ennesima vittoria a favore del consumatore che in prima battuta si era visto negare ogni rimborso/risarcimento. Ecco la SENTENZA .
La morale è che non bisogna cedere ai rifiuti, la maggior parte delle volte appartengono a strategie aziendali volte a sfruttare la debolezza del consumatore che preferisce lasciar perdere.
