Le Sezioni Unite, a risoluzione di contrasto, hanno affermato che, ove gli elementi costitutivi della pensione di inabilità prevista dall’art. 12 della legge n. 118 del 1974 siano maturati prima del compimento del sessantacinquesimo anno di età e la relativa domanda amministrativa sia stata proposta prima di tale data, la sostituzione con l’assegno sociale opera dal primo giorno del mese successivo a quello del compimento del sessantacinquesimo anno, anche se ciò comporta che non venga pagato neanche un rateo della pensione di inabilità e si debba corrispondere direttamente l’assegno sociale.
