NO A CHIUSURE, MAXI SANZIONI E CONFLITTI INTERNI CHE INDEBOLISCONO IL SISTEMA TURISTICO ITALIANO. SI’ AD UNO STATO CHE RAPPRESENTI TUTTI GLI OPERATORI TURISTICI, OFFRA SERVIZI E NON VENGA PERCEPITO SOLO COME UN IMPOSITORE.

Agli Stati Generali del Turismo, tenutisi a Sanremo il 19 e 20 ottobre, è intervenuto Sergio Lombardi, consulente di Primoconsumo in materia turistica.

Il dibattito comprendeva tra gli altri, personalità come Alessandro Nucara, direttore generale Federalberghi Confcommercio, Giulio Del Balzo, public policy manager Airbnb Italia e Gian Marco Centinaio, Ministro del Turismo.

Sergio Lombardi, intervenuto alla manifestazione come esperto indipendente del settore, ha fornito durante il suo intervento i dati nazionali del fenomeno extra-alberghiero in chiave fiscale e macroeconomica, suggerendo all’On. Ministro la non introduzione delle nuove chiusure stagionali e delle maxi sanzioni annunciate per le strutture.

Entrambe le misure, invocate con forza da Federalberghi, hanno avuto nel recente passato e avrebbero oggi solo effetti negativi:

  • le chiusure stagionali obbligatorie per Bed&Breakfast e Case Vacanze sono già state dichiarate illegittime dal TAR dal regolamento regionale per il Lazio nel 2016 a seguito del ricorso dell’Autorità Garante della Concorrenza (Antitrust), in quanto misure che violano le norme sulla concorrenza e sul libero mercato*;
  • le nuove maxi sanzioni ipotizzate non rispettano i principi giuridici di ragionevolezza e proporzionalità e pertanto potranno essere facilmente impugnate, se introdotte. Inoltre esistono già sufficienti e capillari sistemi sanzionatori comunali, regionali e nazionali, amministrativi e fiscali;
  • le chiusure stagionali, le eccessive sanzioni e la iper-regulation (massa eccessiva di adempimenti fiscali, amministrativi e statistici) hanno effetto controproducente, generando una “fuga” degli operatori dal sistema legale, come avvenuto negli ultimi 4 anni, con la diminuzione delle strutture registrate e la enorme crescita del sommerso.

Il settore turistico extra-alberghiero, ha ricordato alla platea Sergio Lombardi, è uno fra i più ricchi in Italia, con un milione di case online in affitto ai turisti su Airbnb, Booking e gli altri portali e probabilmente il comparto con la maggior crescita.

Un settore dal valore di due miliardi di euro come quello del turismo immobiliare, con un potenziale gettito fiscale annuo superiore a 400 milioni di euro, non può che essere considerato una risorsa nazionale, soprattutto nella stagnante situazione economica attuale.

L’auspicio di Sergio Lombardi sull’argomento:

Il corrente livello di tassazione del settore delle locazioni brevi è ragionevole e sostenibile, con una aliquota al 21% di cedolare secca. Purtroppo, il D.L. 50/2017 è ancora parzialmente inapplicato, con una vasta area di inadempimento fiscale. Attraverso l’opera degli intermediari e dei professionisti, le strutture extra-alberghiere e le locazioni turistiche potranno adempiere ai loro obblighi e contribuire pienamente alle casse dello Stato. A quel punto, verranno meno i sospetti, la sfiducia e le accuse trasversali fra categorie che attualmente indeboliscono il settore turistico. Lo Stato deve sovraintendere al settore, dettando e presidiando le sue regole, ma consentendo la libera concorrenza e offrendo servizi, migliorando così il suo rapporto con gli host contribuenti e ottenendo maggiori entrate.

E così l’ospitalità extra-alberghiera, che già consente a milioni di turisti di visitare l’Italia, concorrerà al benessere della nazione nella piena legalità, facendo parte a tutti gli effetti del sistema Paese.
